The job is to try to win. In civil cases juries are selected by plaintiffs and defendants in an effort to maximize the likelihood that the jurors will identify with one's client (or his or her interests) and not with one's adversary (or his or her interests). Got a Jihadi terrorist for a client? Try to exclude the Jews. Might be malpractice NOT to try to exclude the Jews. The judge isn't going to do it if you say you are excluding the Jews, just like the judge isn't going to do it if you say you're trying to exclude the African Americans. So trial lawyers have to be a bit more cagey -- and they generally are. But, try to exclude the Jews from a trial for your Jihadi terrorist client? Sure!
