The prosecution had to open a trial regardless of an earlier recommendation by the ministry of the interior (OM) in the Netherlands to forget the whole thing. However, in the case of the Netherlands people can appeal against the prosecution's initial judgement. So the recent statement is a repetition. Legally this all is very complicated. I listened to an interview in dutch radio programme "met oog op morgen" on 15.10.10 with a law professor at the university of Leiden (between The Hague and Amsterdam). I have to listen to the podcast again to really understand this. Once one enters the muddy waters of restricting free speech there is no more common sense at the far end of the tunnel. Even making use of the very open dutch drug laws will not reveal the light of common sense to me in the trial. Maybe Mohammed stood trial for his antisemitic remarks and his only way out was to claim it were the words of god himself. Monty Pythonesque, as you say.
