Why didn't he use them.

Could be any number of reasons.

He may have died before any order to use them was issued.
He could have issued the order but the troops involved refused to use them.
They may not have been ready for use. The majority of the intelligence and the evidence on the ground shows that programs (illegal) were ongoing, but little evidence of battlefield ready weapons.
Perhaps the 45 minute claim that came out of Iraq was a bluff to try and scare the Americans off.
