Nozzi, you have underlined 'unless they first fight you there'. The there refers to the Kaaba. Therefore there is no restriction on killing the pagans elsewhere i.e slay them wherever ye catch them. And the reason given for slaying them is tumult and oppression (fitnah). Who decides what is fitnah. By your prophet's definition if Muslims are prevented from preaching Islam it is fitnah. It is also fitnah if an unbeliever preaches his religion to Muslims.
When the Muslim preaches to the kaffir he is told that his idols are false gods. The kaffir is expected to take this insult without protest, protesting would amount to fitnah. When the kaffir preaches to the Muslim he will have to tell the Muslim that there are other gods besides Allah. This is also fitnah!
The Muslims always want to be in a win-win situation.
